1. Introduction

Welcome to ValleyStonePark ("we," "us," or "our"). These Terms & Conditions ("Terms") are applicable to your usage of our yacht charter services and our web platform reachable at valleystonepark.sbs, controlled by ValleyStonePark.

When you secure a charter or use our Service, you consent to comply with these Terms. Should you not agree with parts of these terms, you are not permitted to use the Service.

2. Service Overview

ValleyStonePark offers an array of upscale yacht charter services, which include the following:

• Yacht rentals for a day
• Evening cruises
• Company retreats
• Private gatherings
• Charters spanning multiple days

These services are provided based on their availability and dependent on current weather conditions. Service offerings may be modified or ceased at our discretion at any time.

3. Booking and Reservations

3.1 Booking Process

In order to arrange a charter, you must:

• Have attained at least 18 years of age
• Ensure that all provided details are accurate and complete
• Submit the requested deposit outlined in your booking confirmation
• Accept these Terms & Conditions

3.2 Confirmation

A booking is confirmed solely with payment receipt and our written acknowledgment. We reserve the full right to decline service to any individual as we see fit.

3.3 Availability

Charter reservations are subject to yacht availability and appropriate weather for sailing. We'll strive to accommodate your desired dates and hours.

4. Payment Terms

4.1 Pricing

All prices are presented in € and incorporate applicable taxes unless indicated otherwise. Prices may fluctuate without prior indication.

4.2 Payment Schedule

• Deposit: An upfront payment of 50% of the total cost for the charter is required at the time of booking
• Balance: The remaining amount is to be paid 48 hours in advance of the charter's departure
• Any extra costs (should there be any): Made payable at the conclusion of the charter

4.3 Payment Methods

We accept popular credit cards, direct bank transactions, and certified checks. Our payment processing utilizes secure, encrypted mechanisms.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• If cancellation occurs more than 72 hours before departure: You're entitled to a complete refund minus processing expenses
• Between 24 to 72 hours before departure: You're eligible for a 50% refund
• Less than 24 hours before departure: Refunds will not be available

5.2 Weather Cancellations

In case our captain judges weather conditions as hazardous, we will propose either:

• A new schedule for your charter at no additional charge, at the next suitable opportunity
• A full refund if rearrangement proves to be unfeasible

5.3 Mechanical Issues

Should your allocated yacht encounter mechanical issues, we will try to arrange an alternative. In the absence of an alternative, a full refund will be returned.

6. Safety and Conduct

6.1 Safety Requirements

It is required that all passengers:

• Adhere to all instructions from the crew
• Utilize safety equipment as necessitated
• Notify us of any health conditions that may influence their onboard safety
• Stay in the yacht’s designated areas

6.2 Prohibited Items

The following items are prohibited on board:

• Glassware
• Illegal substances
• Guns or other weaponry
• Excessive quantities of non-alcoholic drinks beyond reasonable personal consumption
• Pets (not allowed unless given explicit approval)

6.3 Conduct

Passengers are expected to behave in a civilized manner. Our service retains the right to end a charter prematurely without return of payment if a passenger’s behavior is deemed as a safety risk or interrupts the enjoyment for other individuals.

7. Liability and Insurance

7.1 Our Liability

Our liability for any circumstances is restricted to the charter fee paid. We are not liable for:

• Personal harm sustained due to passenger negligence
• Losses or damages to personal articles
• Indirect, ensuing, or punitive damages
• Delays resulting from inclement weather or conditions out of our control

7.2 Insurance Coverage

We carry complete marine insurance that covers our fleet and operations. Passengers are advised to obtain their own insurance for travel and personal belongings.

7.3 Assumption of Risk

Engaging in our charter services denotes acknowledgment of inherent risks in maritime activities, and you assume personal responsibility for your safety and welfare.

8. Modifications and Itinerary Changes

Itinerary adjustments, including routes or schedules, may be altered due to weather factors, safety concerns, or operational demands. We will make every conceivable effort to deliver comparable replacements.

9. Force Majeure

We shall not be held accountable for disruptions, cancellations, or changes caused by unforeseen elements outside our reasonable control, such as:

• Extreme weather phenomena
• Natural calamities
• Governmental regulations
• Port shutdowns
• Operational failures

10. Privacy and Data Protection

We responsibly manage your personal data as per our Privacy Policy. Your usage of our services implies agreement to our data collection and utilization as detailed in our Privacy Policy.

11. Intellectual Property

All material on our website, whether text, visuals, logos, or pictures, is defended by copyright and trademark laws. Any form of duplication, distribution, or creation of derivative content without our express consent is prohibited.

12. Governing Law

These Terms are directed by the laws of France. Disputes, if any arise, will be determined in the jurisdiction of the courts in Nice, France.

13. Changes to Terms
